Board of Adjustment


The Board of Adjustment is a board that provides a vehicle for citizens to appeal zoning interpretations and decisions of the building official, and request variances from the City’s zoning ordinance. The main purpose of the Board is to provide a “release valve” for those situations where literal enforcement of the City’s Zoning Ordinance may impose unnecessary hardship. The Board may also make final decisions regarding changes, the reestablishment, or termination of nonconforming uses within the City. 


Meetings

The Board of Adjustment meets as needed at the City Council Chambers.


Membership

The Board consists of five members who are residents of the city, appointed by the mayor, subject to confirmation by the city council.  The mayor also shall appoint, subject to confirmation by the City Council, four alternate members of the board who shall be residents of the City, but who shall not be members of the City Council or Planning and Zoning Commission. Alternate members shall, upon request by the chairperson of the board, serve on the board in the absence of one or more regular members, so that all cases heard by the board will always be heard by five regular and/or alternate members.

Selection Process

Nominations to boards and commissions, unless otherwise provided by the Charter or the Code of Ordinances, shall be made by the Council members. The City Council shall confirm nominations for appointment to the board or commission in order for an appointment to be effective.​
